German Federal Constitutional Court declares Berlin Rent Cap unconstitutional

The German Federal Constitutional Court ruled on April 15, 2021, that the Berlin Rent Cap (MietenWoG Bln) was unconstitutional and thus void. The court stated that the federal government had already exhaustively regulated rent price law, leaving no room for state legislation. This decision invalidated the rent freeze, rent caps for re-lettings, and prohibitions on excessive rents introduced by the state of Berlin.
